Laws - Justice - Punishment

LAWS OF HOME STONE

1. "Laws of a home stone shall extend no further than its city walls" -- any further than that is maintained by the use of Turia's Military Force, as Turia does claim certain land holdings outside the city walls. 
 
1A.  The city of Turia is under complete Warrior Caste rule.  This consists of the Ubar and his Warriors.
There is no higher authority than the Ubar himself, and there is no High Council.  However, city meetings are conducted to heed the concerns of the Turian people and to give them free voice. 
"An Ubar gives no accounting." -Assassin of Gor, page 406

1B. Theft or desecration of the home stone is a capital offense punishable by death in boiling oil, or impalement, or execution in any manner the Ubar deems fitting.

1C. To touch the home stone of Turia shall incur the penalty of Death. Only the Ubar is permitted to move the home stone for the purpose of swearing in. In times of War, only the Ubar may touch the home stone.
 
VISITORS TO THE CITY OF TURIA.

1. All visitors to the City of Turia must be approved by the Ubar of Turia, and all visitors must procure a Guest Pass issued by the En'Scribe of Turia.  If a guest's stay in Turia will exceed term of the guest pass issued, they must request an extension of their visit to the Ubar himself.
2. Players, Poets, Musicians, Singers, Entertainers may freely enter the City of Turia, as long as they inform the Ubar of Turia of their presence in the City.
3. Under the Law, Players, Poets, Musicians and Singers cannot be collared for committing a crime. They can however be arrested, imprisoned or killed for breaking any laws that warrant such punishments.
4. Only Assassins who are Registered in their Caste may only enter the City of Turia by informing the Ubar of their intent to enter the city before they arrive, and showing valid contract and proof of Black Caste registration, or reason for their visit. Non Registered Assassins are not permitted within Turia and any AA's they attempt shall be rendered null and void.
5. Initiates may freely enter the city of Turia when on peaceful missions within the City. It is expected that Initiates will inform the Ubar of Turia of their presence in the City.  Initiates may advise the Ubar on religious matters concerning the Priest-Kings and sacred Temples. 
6. Ubars, Ubaras, Administrators and other high ranking officials who visit the City of Turia shall be given every respect and courtesy by the people of Turia.


LAWS CONCERNING CASTE

1. Any Turian citizen who refuses to practice their livelihood or strives to alter their caste without the consent of the Ubar of Turia is an Outlaw and can be subject to impalement. However, as Torvs do not follow the Caste system, people of Torvaldsland are not subject to the laws of Outlaws if they are visiting the City of Turia and possess a valid guest pass.
2. Panther girls and Talunas are considered outlaws and shall be slain or collared upon sight.
3. Changing of Castes:
A Free Person's Caste may be legally changed only with the Permission of the Ubar of Turia and only with proper justification for the change. Approval for change of Caste is contingent upon the Free Person's qualifications for the new caste and the willingness of the new caste to accept them.
3.A.  In a Free Companionship, a free companion can take the Caste of her male Free Companion.


LAWS PERTAINING TO FREE MEN

1. Free Men of Turia are expected to contribute to the welfare, safety and prosperity of the city through the practice of their trade, profession, or Caste.
2. In times of War, all Free Men of Turia except for the Caste of Initiates are expected to take up arms in defense of the home stone should the peril warrant it.
3. Free Men of Turia shall never dishonor themselves or any Free Woman within Turia by face stripping, raping, or collaring a Free Woman Citizen or Guest. If a Free Woman is witnessed exhibiting behavior that warrants the collar, she shall receive it as prescribed under the Law. (See the Punishment Section)
4. When visiting the cities of Turia's allies, or any city who is a prospective ally, both Men and Free Women of Turia shall conduct themselves honorably and abide by that city's Laws.
5. Any Man who challenges, or attempts to challenge the powers and authority of the Ubar of Turia incurs the charge of High Treason.
6. Men of Turia are expected to provide for their Free Companions and children through the earning of coin by honorable means.

LAWS PERTAINING TO FREE WOMEN

1. Dress Code: Robes of concealment, veils, gloves, haiks, and Sari's are all acceptable clothing for women in Turia.
2. Women in the Caste of Physicians cannot practice medicine until they first bear two children. At age fifteen en'vars, women shall place two bracelets on their left wrist. One is removed for each child that is born. 3. Face stripping a Free Woman of Turia by forcefully removing her veils is a serious crime and will be punished to the fullest extent of the law.
4. A free woman can sell herself into slavery. However, once it is done, she cannot revoke it.
5. If a free woman submits to be a slave to a specific man, and that man refuses the offer, she still shall become a slave, subject to capture by the first person to collar her.
6. Any free woman who couches with another's slave or even prepares to do so, becomes a slave herself and becomes the slave of the male slave's master. This is known as the "Couching Law."
7. The crime of false yielding is a capital offense punishable by Death. It is easy to detect, through infallible physiological signs.
8. The principle of "conduct befitting the collar" deals with conduct by a free woman sufficient to warrant her reduction to slavery. It is commonly applied to fraud, theft, indigency, vagrancy, prostitution, and indulgence in sensuous dance. Other behavior which might trigger the principles includes attempting to spy on masters and slaves, disguising oneself as a slave, garbing oneself as a slave even in the supposed secrecy of one's own compartment, baring too much flesh, lingering about slave shelves and markets, and even exhibiting an interest in or fascination with enslavement. The principle deals with overt behavior and not thoughts. The Swords of Turia and the Magistrate of Turia shall decide if such behavior is sufficient to warrant a reduction to slavery if the woman is of Low Caste. If the woman is of High Caste, the Ubar shall determine her fate.  
9. There is no law that states a man may enslave a free woman of his Home Stone because she has insulted or disrespected him. However, a woman who commits or attempts to commit Manipulation shall under the Law be punished by the Free Man she had targeted for Manipulation.
10. Any Free Woman or Free Man that kneels in submission before a Man or addresses him as Master effects legal enslavement on themselves and becomes his slave.
11.  A Free Woman may not sell her children into slavery to cover her debts if the Father is a Citizen of Turia. This matter must instead be resolved in the Court of the Magistrate of Turia. 
12.  Under Gorean Law, a Free Woman who is captured and then rescued by a Free Man, may under the right circumstances be awarded to the Free Man who rescued her if he requests it.  This is due to the Free Man's valor and willingness to risk his life to save the woman.

LAWS GOVERNING SLAVES

1. Slaves are considered property, on the same level as animals. Their owner may do anything they wish to them without repercussion. An owner can kill his own slave at his own whim. If a Master who is not the slave's owner kills a slave, he need only compensate the Owner for the value of the slave in coin. However, no Man in Turia will kill or maim A Turian Free Man's slave simply for sport or amusement. To do so is a show of disregard and disrespect for the slave's Owner's right to his own property.
2. Slaves do not own anything, including their own name. Even though they may use goods, they do not own them.
3. Female slaves must wear a visible token of their slavery within the city limits, normally a collar. Male slaves are exempt from wearing a collar, though they may wear other tokens of slavery, such as the arm cuff. It is not good for male slaves to understand their true numbers.
4. When a person is collared, it cancels their past. They begin a new life as a slave and may not be held accountable for any crimes that occurred while they were free.
5. It is illegal for slaves to play Kaissa. It is considered an insult to free men, not only for a slave to play but even to touch the pieces.
6. Any free person may discipline an insolent or errant slave, even one who is in the least bit displeasing. However, destruction of the Ubar of Turia's personal property, such as killing his slave, is punishable by law.
7. In any legal proceedings, the testimony of slaves may be taken by torture. This is solely in the discretion of the courts of Turia.
8. The property of one who becomes a slave is transferred to the nearest male relative or the nearest relative if no male exists, or to the city, or a guardian. Even if the slave is later freed, the property cannot ever be recovered.
9. For a slave to run away from his/her owner is a serious offense. For the first offense, the penalty is commonly a severe beating. For a second offense, the slave shall be ham strung.
10. Slaves are not permitted outside the city gates unless accompanied by a free person.
13. It is a capital offense for a slave to wield any weapon.
14. It is a capital offense for a slave to claim caste.
15. It is a capital offense for a female slave to wear the garments of a free woman.
16. It is illegal for a slave to wear veils.
17. Slaves are not allowed to build anything. That right is reserved for free people only.
18. It is illegal for slaves to touch or handle legal documents.
19. Slaves shall not teach free people.  By teaching someone, they are placed in your debt and nothing can be owed to a slave.
20. If a slave fails to kneel in the presence of a free person, it can be a capital offense, especially if the slave intentionally fails to do so. In that case, the slave shall be tortured to death.
21. Any slave that kneels to an Assassin without the Ubar of Turia's consent can under the Law be enslaved by the Black Caste.
22. Barbarian women have no Home Stone, therefore there are no legalities that prevent their capture and enslavement.
23. A free woman may do a form of limited self-contracting where she legally becomes a slave for a specific time period, commonly ranging from one night to one en'var. She cannot end this contract earlier than the specified time period. Once the contract takes effect, she becomes a slave with no legal rights of her own.

LAWS GOVERNING BEASTS OF WARFARE

Beasts of Warfare are defined as Tarns, Sleens, War Kaiila and Thalarion.
Beasts of Non-Warfare include Larls, Hiths, Osts, Herlits, other breed of Kailla, and other creatures which have the ability to seriously injure or kill a person.

All Visitors and Citizens of Turia are expected to adequately control and house their beasts in a manner which renders them not dangerous to the people of Turia.

Any Visitor or Citizen of Turia who is clearly negligent in properly controlling and restraining their beast(s), which results in serious injury or death of a person in Turia, will have their beast(s) confiscated and the Owner placed on trial for Murder and/or gross negligence.

LAWS NOT DOCUMENTED ABOVE:  (See Punishment Section Also)
1. Thievery (Committed by Free Persons):  The first offense is punished by an ear notching by the Magistrate of Turia. For a second offense, the punishment depends on the Gender of the offender. Men are punished by the loss of their left hand and both feet.  Free Women are punished by enslavement.

1.A. Thievery (as Committed by Slaves): First offense is the Penalty Brand.
Second Offense is Death.

Other Crimes and Punishments Warranted for Slaves:
1. Striking a Free Person - Death.
2. Speaking confidential information about the City or about a Master or Mistress to any Free or Slave: The penalty is torture and Death.
3. Acting as Spy for any person or entity for malevolent purposes against the City: Torture and Death.


RELIGIOUS LAWS OF TURIA
 
The Temple is considered the most holy place of the city of Turia.  It must never be defiled.  Ways in which a Temple, under the Laws of Gor, may be defiled:
1.  The carrying of weapons into the Temple.  Weapons must be left at the door before entering.
2.  Allowing slaves to enter the Temple.  There is a gated enclosure near the entrance of the Temple for the keeping of slaves while their owners enter the Temple.  No slave shall enter a Temple of the Priest-Kings. Doing so defiles the Temple and is punishable under the law by Immolation (death by fire).
3.  The shedding of blood within the Temple.
4.  Vandalizing, robbing, or defacing of the Temple building.
Defiling a Temple under any circumstances is punishable by Death.

 
Justice and punishment is handled in Turia in the following courts:
 
A1.)  The Court of the Ubar, which includes his appointed Swords.   The Ubar shall judge all crimes that levy a sentence of capital punishment (Death), which includes but is not limited to:  Treason and Conspiracy, Murder, Espionage, Kidnapping, Arson within the city of Turia, desecration of sacred Temples, Perjury against the Ubar, his Swords or the Magistrate of Turia, falsifying the seals and brands of the Ubar and his family, any forms of duplication of city keys, passes, maps without the permission of the Ubar himself.  In the court of the Ubar, the Magistrate of Turia shall be present during trials as a neutral, advisory entity. 
 
A2)  The Court of the Ubar shall also judge all cases involving any citizen or guest of High Caste, and all cases involving a Warrior of the Red Caste.
 
B.)   The Lower Court of the Magistrate.   The Magistrate of Turia shall judge all non-capital crimes and cases.   This includes but is not limited to:   Theft, Debts, Custody disputes, Companionship Contract disputes, Enslavement (if the free woman is of Low Caste only, High Caste free women are judged by the Ubar), Merchant Caste disputes, any dispute between citizens of Turia or guests of Turia, and any other case that the Ubar may assign to him.
 
C) Appeals Process.   Appeals to any sentences must be made to the Ubar of Turia.  If the appeal involves a Free Woman who was sentenced to Enslavement, a member of her family or another Free Person must make this appeal on her behalf, as slaves have no rights.
 
 
II.   Keeping of the Peace in the Home Stone of Turia.
 
A)  The Warrior Caste of Turia is the primary peace-keeping force within the Home Stone of Turia.  They will question and detain any who disrupt the peace and safety of the city.   The Ubar's Swords are not required to have an Arrest Warrant in order to detain any individual.  If a citizen or guest feels himself/herself in danger, they should alert a Warrior of Turia first.  If no Warriors are present, then the Magistrate of Turia and the Guard of Turia should be alerted.
 
A1.)  Concerning the collaring of Free Women:    The Warriors of Turia have the right, if clearly warranted, to collar any Free Woman of Low Caste who has earned the collar, without trial.  If the case is a Free Woman of High Caste, the Warriors of Turia shall detain the woman to await the judgement of the Ubar.
 
B)  Secondary policing of the City of Turia is conducted by the Magistrate of Turia.  The Magistrate of Turia will question, with the right to detain if necessary, any individual who disrupts the peace and safety of the city if no Warriors are present.   The Magistrate of Turia has the right, if clearly warranted, to collar any Free Woman of Low Caste who has earned the collar, without trial.  If the case is a Free Woman of High Caste, the woman shall be turned over to the Warriors of Turia for further and proper investigation of the matter.
